These general conditions of sale apply to individuals and to all products, accessories and spare parts of the Thias skwal® range, sold online on the website https://thias-skwal.com or directly from our sales department.

By purchasing on the site, the customer accepts these general terms and conditions of sale.

You must register on the site in order to order our products. In accordance with the provisions of Law 2014-344 of 17/3/2014, a complete summary of your order will be presented to you before payment, and recalling the characteristics of the products ordered, their prices and quantities, total amount excluding VAT and including VAT of the order including delivery time taking into account product availability, costs and mode of delivery, billing and delivery address, payment method applied.

An e-mail confirmation will be sent to you, including all the elements of your order. We reserve the right to modify the prices at any time, but the products will in all cases be invoiced on the basis of the original rates at the time of order.

The payment of the order is made by bank transfer or check. The shipment of the order is carried out only on receipt of payment

The order will be considered as firm and definitive only at the end of the payment procedure. Thus, we reserve the right to refuse any order or to honor a delivery in case of payment dispute. The products remain our property until full payment is received.

Skwal and co SASU undertakes to process your order within 48 hours (working days).

Withdrawal period: in application of the law of 17/3/2014, you have a right of withdrawal of 14 days after receipt of your products, by sending an e-mail to : Contact@thias-skwal.com

The price of products sold are those in effect at the time of order . They are denominated in euros and calculated without taxes. Consequently, they will be increased by the rate of VAT, transport costs and if necessary taxes relating to customs duties and imports of the country of destination, applicable at the time of order.

Skwal and co SASU reserve the right to modify prices at any time. However, they undertake to invoice goods at prices indicated at the time the order is registered.

Our delivery times are given as an indication only, not as a guarantee. Consequently, our customers cannot claim, in case of delay, any compensation or cancel even partially their order.

Our standard delivery times are 3 working days for France and 8 working days for Europe. Express delivery on request, according to destination. Please consult us.

Our goods are sold from our warehouses. Unless otherwise agreed with the customer, we reserve the right to choose the carrier.

The customer shall bear the carriage risks in full until delivery. It is the responsibility of the recipient to make immediate reservations to the carrier in case of shortages, damage or delay. To be valid, these reservations must be confirmed by registered mail within 48 hours after receipt of the packages to the carrier, the customer also informs Skwal and co SASU.

Claims concerning the quality of the goods, excluding any transport dispute, must be made within 8 days. After this period, any claim concerning the goods will be refused.

Thias skwal® products have been designed and tested to withstand normal use. They are guaranteed for 24 months against any manufacturing defect or damage not resulting from abnormal use, normal wear and tear being excluded from the warranty. The same applies to damage occurring during transport or storage of the product, failure to comply with the instructions for assembly and use described in the manual enclosed in the packaging, or in the event of modification, shocks produced by sharp objects, torsion, compression not resulting from normal use.

The warranty will not apply to any malfunction resulting from assembly play on the screws, the regular verification of the state of tightening of the latter being the responsibility of the user.

Similarly, the warranty can only be applied to a product returned in its original packaging or equivalent, and in the absence of any modification or repair not carried out by us.

The warranty will consist of the choice proposed by the manufacturer between repair and replacement of the defective parts, at the consumer’s discretion, without this choice leading to disproportionate costs compared to other choices.

The warranty period of 24 months runs from the date of delivery, or, in the absence of a delivery note signed by the customer, from the invoice + 8 days, and can only benefit the holder of the original invoice issued by us.

This warranty applies in any country of destination of the initial sale, except under special conditions in connection with the legislation of the country of destination.

Limitation of liability:

The warranty is exclusive of any other liability of the manufacturer for any consequential damages resulting from the defect found, including loss of use.

Abnormal use, outside the purpose described in Article 1, and in particular for competition, is not covered by the warranty.

When renting Skwal and co, the customer must have a valid civil liability insurance. The rental does not include evacuation insurance in case of accident.

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.
In the absence of amicable resolution, the dispute will be brought before the Commercial Court of Valence (Drôme).

In case of dispute, the French version of the terms and conditions will be applied.
